Are you looking to take your knowledge of employment law to the next level? This Postgraduate certificate course provides knowledge and skills that are directly relevant to the practical employment issues faced by lawyers, HR managers, personnel officers and all those involved in staffing.

The course is the first of three stages of the LLM Employment Law in Practice. On completion, you’ll be ready to apply for the postgraduate diploma (PGDip) and then, once you have the diploma, for the LLM.

For the PG Cert you’ll study three modules that have been developed in consultation with HR professionals and solicitors. Topics include employment relationships and how to terminate them as well as legal research and study skills at postgraduate level.

The distance learning mode offers a high level of flexibility, allowing you to undertake postgraduate study while also pursuing a career. Supported by the latest technology, you’ll enjoy being part of a collaborative learning community as you continue your professional development. This course is not eligible for the postgraduate government loan.

Please note, optional module choices will be grouped and will run in designated blocks, meaning some module combinations will not be possible. Although every effort is made to ensure that these modules are offered, there may be occasions, for example due to staff sabbaticals, where a module may not be offered or module running order may change.

This is a distance learning course and you’ll learn through expertly written learning materials that help you engage with topics in interactive ways. Like other Masters courses there is a significant element of independent learning and self-motivated reflection.

The pace of the course is controlled to make it easier for you to balance work, study and life commitments. Each module includes an optional study day at the University. If you’re unable to attend, you can still watch the recording that will be made available through the eLearning Portal.

We encourage online communities to flourish among all those taking the course, ensuring that you can interact with fellow students. Further support on academic matters is provided by a Personal Tutor who is available to you throughout the course.

Assessment methods are designed to give you feedback as well as to monitor your level of achievement. You can expect both your tutors and your peers to provide useful comments and feedback throughout the course.

As a distance learner you’ll have full access to our eLearning Portal, ‘Blackboard Learn’, which includes web conferencing, study notes, discussion boards, virtual classrooms and communities. Blackboard Learn brings together all aspects of course management as well as assessment and feedback. You can contact tutors in other ways too, including by email and telephone.

You’ll also have online access to Northumbria’s library, which has half a million electronic books that you can read whenever or wherever you need them. At the end of the course the logical next step is to enrol on the PGDip Employment Law in Practice followed by the LLM Employment Law in Practice. This will ensure you complete the Masters qualification.

This PG Cert distance learning course is for professionals (including HR managers and lawyers) who want to take their knowledge of employment law to the next level.

Entry Requirements 2019/20

Standard Entry

Applicants should normally have:

A minimum of a 2:2 honours degree in Law, or an honours degree with law modules.
Relevant professional qualifications or suitable experience will also be considered.

Legal Research (Core, 20 Credits)

This module seeks to prepare you for the legal research you will be undertaking on your postgraduate programme. This will ensure that you have an appropriate understanding and awareness of appropriate research methods with a particular focus upon: seeking and obtaining legal research sources, recording that data to an appropriate academic standard including issues of referencing and plagiarism, along with effective communication of research methods for example in written essays and oral presentations. The module focuses on the development of skills in three keys areas: problem identification and analysis, information gathering and presentation of results.

Terminating the Employment Relationship (Core, 20 Credits)

In this module you will learn about the law as it relates to the termination of the employment relationship using realistic practical scenarios You will learn about the consequences of terminating the employment contract at common law, focussing on summary and wrongful dismissal and remedies. A significant part of the module will concentrate on the law relating to unfair dismissal when you will learn about the criteria to qualify for the right to claim unfair dismissal and on what grounds you can argue unfair dismissal.

You will explore how employers can conduct themselves fairly and lawfully when dealing with their employees in order to minimise the risk of claims arising from the termination of employment such as for wrongful or unfair dismissal. You will develop an understanding of the role and purpose of ACAS and its statutory code of practice on disciplinary and grievance procedures. You will learn about the remedies available for unlawful termination of employment.

You will also consider wider consequences of termination of the employment relationship such as the impact it will have on contractual provisions such as restraint of trade clauses and payment in lieu of notice clauses. You will learn about the rights and obligations of both employer and worker during the notice period. You will also learn about the ways that you can settle any potential claims arising on termination of the employment relationship.

o Remedies
• Statutory protection
o Qualifying to claim unfair dismissal
o Types of dismissal, e.g. actual and constructive dismissal

• Statutory and other provisions relating to disciplinary and grievance procedures and drafting issues
• Contractual considerations when terminating the contract
o Restraint of trade provisions, etc
o Rights and obligations during notice
• Settlement of potential claims arising on termination of the contract

The Employment Relationship (Core, 20 Credits)

The aim of the module is to introduce you to the law relating to the formation and structure of the employment relationship. You will consider the statutory definitions of “employee” and “worker” and related case law. The module will consider the various means of engaging labour and the respective legal implications of each as well as the rights and obligations of each of the parties.

You will also consider the formalities of engaging employees in particular and the terms under which they are engaged. The module will also consider the legal consequences of the employer not observing any applicable legal obligations

The module considers;

• Sources of modern employment law.
• The relationship between the employer and its employees, “workers”, modern apprentices and the genuinely self-employed.
• Overview of Contract Law and how it relates to the employment relationship
• The contract of employment: legality; formalities and; express and implied terms.
• The remuneration package, including holiday pay.
• Working time.
• Means of protecting sensitive information: an overview.
